Media Terms and Conditions

Agreement upon Check Out

By purchasing a digital image from Cycloworks you are agreeing to be bound by these Terms and Conditions of Use. Please read this agreement before you download or purchase any image.

Parties to the License

This is an agreement between Cycloworks and the individual purchaser.  

Rights:

All images and rights relating to them, including copyright and ownership rights in the media in which the images are stored, remain the sole and exclusive property of Cycloworks.com.  This license provides the purchaser a non-exclusive perpetual personal-use license to download and copy the accompanying image(s) or video(s) (collectively, "Media,") subject to the following restrictions:

• This license is for personal use only. Personal use means non-commercial use of the Media for display on personal websites and computers, or making image prints or video copies for personal use. The Media may not be used in any way whatsoever in which you charge money, collect fees, or receive any form of remuneration. The Media may not be used in advertising. The Media may not be resold, relicensed, or sub-licensed.
• Title and ownership, and all rights now and in the future, of and for the Media remain exclusively with the Cycloworks.com.
• There are no warranties, express or implied. The Media are provided 'as is.'
• Cycloworks.com is not liable for any third party claims or incidental, consequential or other damages arising out of this license or buyer's use of the Media.

Usage Limitations

Free Downloaded Images:

• Any Media downloaded, copied, or reproduced for free must retain the Cycloworks.com copyright, and attribution via digital media reproduction (websites, blogs, Facebook, etc) must provide a "Picture by Cycloworks.com" or a link back to http://cycloworks.com if possible.

• Purchased Media are for personal use only.
• Non-commercial use of the Media for display on personal websites and computers, or making image prints or video copies constitutes personal use.  The Media may not be resold, relicensed, or sub-licensed.
• The Media may be shared or copied for personal use only.  
• The Media may not be used in any way whatsoever in which you charge money, collect fees, or receive any form of remuneration.
• The Media may not be used in advertising.No digital image or prints may be sub-licensed, resold, distributed, or otherwise made available for use or distribution.
• You may not alter any Meida obtained from Cycloworks.com or remove any copyright information imbedded in the digital image file.

Prints

Prints are sold “as is” and become the physical property of the buyer post sale. The images borne by the prints, however, are still protected by copyright and may not be altered or reproduced without written approval from Cycloworks.com.

Commercial Use

If you are interested in using any images for commercial purposes contact Cycloworks.com. The pricing and terms of commercial use will be established by mutual agreement at that time. Any digital image by Cycloworks.com, purchased or obtained from the website under the Personal Use license, or any portion of an image, may not be used without consent in any final materials distributed to the public for advertising and marketing materials or any on-line, broadcast or other electronic distribution system, communication, web pages, marketing or promotional materials, multimedia projects, video, graphic design projects, and general creative works, and may not be distributed, sub-licensed or made available for use or distribution separately or individually.

Termination of Agreement

This Agreement will automatically terminate upon failure by you, the licensee, to comply with any of its terms. If this happens, you hereby agree to destroy all copies and archives of the digital images, to cease using the images for any purpose, and to confirm to Cycloworks.com in writing that you have complied with these requirements.
